Lawyers joined the virtual press conference along with families affected, and Steven Shrybman, partner at Goldblatt Partners LLP, gave a summary of their formal legal opinion regarding the issue. The \u00a0legal opinion, released today, is available <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/index.php\/legal-opinion-proposal-from-southbridge-care-homes-inc-re-orchard-villa-in-pickering-ontario\/\">here<\/a><\/span>.<\/p>\n<p>Orchard Villa LTC in Pickering Ontario gained widespread notoriety for its appalling record during the COVID-19 pandemic. At least 206 of Orchard Villa\u2019s 233 residents contracted COVID-19, along with more than 100 staff. At least 70 residents died. Reports from <a href=\"http:\/\/www.ltccommission-commissionsld.ca\/transcripts\/pdf\/Families_of_Orchard_Villa_Transcript_October_23_2020.pdf\"><span style=\"color: #3366ff;\">families of residents<\/span><\/a>, the <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.thestar.com\/news\/gta\/2020\/08\/31\/improper-use-of-ppe-medicine-to-the-wrong-patient-injuries-from-falls-a-look-at-the-problems-inside-orchard-villa-as-covid-19-deaths-climbed.html\">local hospital<\/a><\/span>, the <a href=\"https:\/\/www.durhamregion.com\/news-story\/9997513--it-s-our-worst-nightmare-report-details-horrendous-conditions-at-pickering-s-orchard-villa-retirement-residence\/\"><span style=\"color: #3366ff;\">Canadian Forces<\/span><\/a> and repeated <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"http:\/\/publicreporting.ltchomes.net\/en-ca\/homeprofile.aspx?Home=2693&amp;tab=1\">inspections<\/a> <\/span>before and since the first wave of the pandemic provide hair-raising accounts of failures to provide sound infection control; dire understaffing; inadequate hydration and feeding; uncleanliness; flies and cockroaches; lack of vital supplies and egregious lack of care.<\/p>\n<p>According to a <a href=\"https:\/\/www.cbc.ca\/news\/canada\/nursing-homes-covid-19-death-rates-ontario-1.5846080\"><span style=\"color: #3366ff;\">CBC analysis<\/span><\/a>, for-profit LTC chain Southbridge, which owns Orchard Villa, had the worst record among the for-profits during the pandemic with 9 deaths per 100 residents in homes with outbreaks. Orchard Villa had at least 30 deaths per 100 residents.<\/p>\n<p>Not only did the Ford government fail to fine Southbridge for its record, it instead passed <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/index.php\/release-ford-governments-new-legislation-will-make-it-significantly-harder-to-hold-for-profit-long-term-care-homes-liable-for-covid-19-harms\/\">legislation<\/a> <\/span>shielding Southbridge and other LTC corporations (predominantly for-profits) from liability for negligence. Now, the Ford government is proposing to give Southbridge a <a href=\"https:\/\/www.ontario.ca\/page\/ontarios-long-term-care-licensing-public-consultation-registry#21-026\"><span style=\"color: #3366ff;\">new 30-year license and an 87-bed expansion<\/span><\/a> as part of its plans to rebuild and build thousands of new long-term care beds, a significant portion of which they are proposing to hand to the same for-profit chain companies with the worst records.<\/p>\n<p>Families and advocates are outraged and have vowed to fight these plans. The Ontario Health Coalition sent an <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/index.php\/open-letter-open-letter-to-ltc-minister-rod-phillips\/\">Open Letter<\/a><\/span> to the Minister of LTC regarding its concerns about Orchard Villa. Almost 200 people protested outside the home last month. Hundreds of petitions have been sent in to the Minister. Having received no response, the Coalition and the Families of Orchard Villa asked for a legal opinion regarding the lawfulness of the Ford government\u2019s proposed new license and expansion.<\/p>\n<p>&#8220;In our view, in light of Southbridge\u2019s appalling record at Orchard Villa, it would be unreasonable and contrary to law for the\u00a0government to find that Southbridge is eligible to be approved for a new license and expansion at Orchard Villa under s. 98 of the Long-Term Care Homes Act,&#8221; said Steven Shrybman, lawyer at Goldblatt Partners. &#8220;Accordingly, if the government made such a decision, a Court would likely\u00a0find the decision to be unreasonable and quash it.\u201d<\/p>\n<p>&#8220;No reasonable application of s. 98 of the Act could conclude that Southbridge is \u201ccompetent\u201d to operate Orchard Villa, or that its \u201cpast conduct \u2026 affords reasonable grounds to believe\u201d that the home will be operated \u201cwith honesty and integrity\u201d and \u201cnot \u2026 in a manner that is prejudicial to the health, safety or welfare of its residents,\u201d as the words of the <em>Act <\/em>require,\u201d he concluded.<\/p>\n<p>\u201cOn behalf of our loved ones living in Orchard Villa we will continue to advocate,\u201d said Catherine Parkes, who lost her father &#8211;a resident of the home&#8211; in the first wave of the pandemic.\u00a0\u201cWe carry with us daily the defeat and heartbreak of having watched our family members suffer and die.\u00a0\u00a0The personal discussions I have had with family members who still have loved ones living in Orchard Villa reveal that nothing has changed.\u00a0\u00a0I strongly believe that the Long-Term Care Act indicates clearly the direction the Minister needs to take regarding Southbridge Care Home\u2019s request for a 30-year license and an extra 87 beds, which is an absolute denial of their request.\u201d<\/p>\n<p>\u201cWe are extremely concerned that the Ford government, which has close connections with the for-profit long-term care industry, may be ducking the controversy and waiting for people to stop paying attention.
