{"id":19388,"date":"2022-09-04T16:40:30","date_gmt":"2022-09-04T20:40:30","guid":{"rendered":"https:\/\/www.ontariohealthcoalition.ca\/?p=19388"},"modified":"2022-12-02T15:11:35","modified_gmt":"2022-12-02T20:11:35","slug":"france-gelinas-appeals-to-human-rights-for-judgment-on-bill-7","status":"publish","type":"post","link":"https:\/\/www.ontariohealthcoalition.ca\/index.php\/france-gelinas-appeals-to-human-rights-for-judgment-on-bill-7\/","title":{"rendered":"France G\u00e9linas appeals to Human Rights for judgment on Bill 7"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">(September 3, 2022)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">By: Sudbury.com<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nickel Belt MPP and official opposition health care critic France G\u00e9linas believes the rights of some hospital patients are being ignored by government legislation<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ontario&#8217;s official opposition health critic France G\u00e9linas\u00a0is stepping up the\u00a0fight against Ontario&#8217;s Bill 7; the <\/span><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ola.org\/en\/legislative-business\/bills\/parliament-43\/session-1\/bill-7?utm_source=sudbury.com&amp;utm_campaign=sudbury.com%3A%20outbound&amp;utm_medium=referral\"><span style=\"font-weight: 400;\">More Beds, Better Care Act<\/span><\/a><\/span><span style=\"font-weight: 400;\"> that was passed by the governing Progressive Conservatives earlier this week.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">G\u00e9linas said Friday she has written to the\u00a0<\/span><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ohrc.on.ca\/en?utm_source=sudbury.com&amp;utm_campaign=sudbury.com%3A%20outbound&amp;utm_medium=referral\"><span style=\"font-weight: 400;\">Ontario\u2019s Human Rights Commission<\/span><\/a><\/span><span style=\"font-weight: 400;\"><span style=\"color: #3366ff;\">\u00a0<\/span>for a judgment on Bill 7, which she said has the capacity\u00a0to violate the rights of hospital patients who do not wish to be removed from their hospital beds and sent to a long-term care home.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Part of the rationale for the creation of Bill 7 is that the government wants to ensure there are enough acute care hospital beds available in Ontario if the COVID-19 pandemic flares up with a new wave and results in more cases being sent to hospital.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis will take away the rights of frail, elderly people to give consent. When dealing with a health professional you always have a right to consent or the right not to consent; I\u2019m confident the Ontario Human Rights Commissioner will feel the same\u201d G\u00e9linas said in a news release.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In her letter to the Human Rights commissioner, G\u00e9linas said that through Bill 7, any hospital patient designated as ALC (Alternate Level of Care) may be assessed without their consent, have their personal information shared with long-term care home operators without their consent, have applications to long-term care filled out without their consent and be admitted to a long-term care (LTC) home to which they do not want to go, without their consent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;The government of Ontario has abdicated their responsibility to provide community alternatives; like publicly funded home care and long-term care beds, leaving no attractive alternative to long hospital stays,&#8221; G\u00e9linas said in the letter.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She argued that having applications to long-term care filled out without patient consent is a clear violation of a patient\u2019s Charter right to privacy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;In your Commission\u2019s \u201cPolicy on preventing discrimination based on mental health disabilities and addictions\u201d section 16 states \u201cThe power to make decisions about matters that affect one\u2019s own life and to have them respected by law is a fundamental part of realizing one\u2019s rights as an autonomous adult, and indeed, is fundamental to personhood itself,&#8221; G\u00e9linas wrote.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Commissioner, I hope the commission can make recommendations regarding the rights vulnerable seniors seem to be losing under this legislation,&#8221; she added.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Advocacy Centre for the Elderly (ACE), Canadian Union of Public Employees (CUPE) and the Ontario Health Coalition also wrote to the Ontario Human Rights Commission this week asking for an \u201cinquiry (into) age-based discrimination.\u201d<\/span><\/p>\n<p><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.sudbury.com\/local-news\/france-gelinas-appeals-to-human-rights-for-judgment-on-bill-7-5775063\"><span style=\"font-weight: 400;\">Click here for original article<\/span><\/a><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(September 3, 2022) By: Sudbury.com Nickel Belt MPP and official opposition health care critic France G\u00e9linas believes the rights of some hospital patients are being ignored by government legislation Ontario&#8217;s official opposition health critic France G\u00e9linas\u00a0is stepping up the\u00a0fight against Ontario&#8217;s Bill 7; the More Beds, Better Care Act that was passed by the governing [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[21],"tags":[],"class_list":["post-19388","post","type-post","status-publish","format-standard","hentry","category-ohc-in-the-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
