Ontario’s Progressive Conservative government used its majority Wednesday to pass Bill 7, controversial legislation\u00a0that could\u00a0force hospital patients awaiting long-term care to nursing homes not of their choosing on a temporary basis.<\/span><\/p>\n

The government has faced criticism over the vague wording of the legislation, and that it <\/span>opted not to send the draft bill to committee<\/span><\/a>\u00a0\u2014 meaning no public feedback was gathered before it was passed. None of the opposition parties supported the bill.<\/span><\/p>\n

Long-term Care Minister Paul Calandra has said the government moved to bypass the committee phase because of the urgent need to free up acute care beds in hospitals, which have faced\u00a0unprecedented pressures in recent months largely due to a shortage of nurses.<\/span><\/p>\n

Calandra\u00a0said sending patients who need an “alternate level of care” to long-term care homes will help ease that\u00a0burden.\u00a0According to the Ontario Hospital Association (OHA), there were 5,930 alternate level of care”patients\u00a0\u2014 those deemed to no longer be in need of acute care\u00a0\u2014 in hospital as of Aug. 17,\u00a0of which 40 per cent were waiting for a space in long-term care.<\/span><\/p>\n

The new legislation doesn’t allow patients to be physically forced to move to a long-term care home, but it’s not clear what would happen if a patient refuses a transfer. Critics have said that a patient who won’t move could be forced\u00a0to pay the\u00a0uninsured rate of a hospital stay, which can be up to $1,800 per day.<\/span><\/p>\n

Speaking Tuesday, however, Premier Doug Ford said an $1,800 fee in these circumstances would be\u00a0“absolutely ridiculous,” but said hospitals and Ontario Health are working out what the billing amount might be.<\/span><\/p>\n

“We’ll have to work out a cost and the hospitals\u00a0have to work out the cost,” he said. “People are determining that \u2014 it’s not me personally … But I can pretty well guarantee you, it’s not going to be $1,800.”<\/span><\/p>\n

Peter Tabuns, the interim leader of the Ontario NDP,\u00a0said the new law will hurt seniors and cause needless suffering.<\/span><\/p>\n

“It’s very clear: people will get bullied, they will get huge bills, they will be pushed out the door,” he said.<\/span><\/p>\n

Another unanswered question is how far away from their homes patients will be able to moved under the parameters of the bill. The opposition NDP and Liberals have repeatedly alleged that\u00a0in northern Ontario, patients could be moved up to 300 km\u00a0from their homes. Meanwhile, patients in most of southern Ontario could be moved up to 100 km\u00a0away and those in cities up to 30\u00a0km\u00a0from their homes.\u00a0<\/span><\/p>\n

Calandra and his ministry have declined to respond with any specific information about distances, saying those elements of the legislation are still under discussion with stakeholders. Calandra has said, though, that every effort will be made to keep patients “as close as possible” to their families and support systems.\u00a0<\/span><\/p>\n

According to the Ontario Long Term Care Association, homes facilitate over 37,000 transitions from hospitals to long-term care a year, ensuring appropriate flow through 2,200 acute care beds. (CBC)<\/span><\/i><\/p>\n

The minister has promised that the regulations supporting Bill 7, called the <\/span>More Beds, Better Care Act<\/span><\/i>, would be presented in the legislature within a week of the bill’s passage.<\/span><\/p>\n

The legislation is part of a <\/span>larger plan\u00a0first announced\u00a0two weeks ago by Health Minister Sylvia Jones<\/span><\/a> to help\u00a0ease pressures on the health-care system. Proposed changes\u00a0aim\u00a0to\u00a0hire more health professionals, free\u00a0up hospital beds and reduce\u00a0surgical wait lists.<\/span><\/p>\n

Several organizations asked the Ontario Human Rights Commission to use its public inquiry powers under the Human Rights Code to “to investigate systemic discrimination based upon age against the elderly in the provision of health care in Ontario.”<\/span><\/p>\n

“Under the Ford government’s new legislation, frail, vulnerable seniors have been targeted, wiping out their human right to informed consent for health care,” said Ontario Health Coalition executive director Natalie Mehra in a statement Wednesday.<\/span><\/p>\n

“This is a fundamental question of justice. Elderly patients are not taking undue resources any more than other patients. It is the cruelty of ageism laid bare and the Ontario Human Rights Commission must finally take action.”<\/span><\/p>\n

Anthony Dale,\u00a0president and CEO of the OHA, <\/span>previously told CBC Toronto that he supported the passage of the act<\/span><\/a>, noting that the current number of patients needing alternate levels of care is the highest the province has ever seen.<\/span><\/p>\n

Dale said capacity challenges are affecting all patients,\u00a0including people who need urgent care, surgical procedures\u00a0and diagnostics.\u00a0<\/span><\/p>\n

“Ontario’s hospitals are rapidly becoming the health-care provider of last resort for thousands of people who actually need access to home care, long-term care and other services. This is not appropriate for these patients,” he said.<\/span><\/p>\n

Neither Calandra\u00a0nor Health Minister Sylvia Jones made themselves available to answer questions from the media following Wednesday’s session in the legislature.<\/span><\/p>\n
