Colin D\u2019Mello reports.<\/b><\/p>\n<p>As a health-care advocacy group prepares to take the\u00a0<span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/globalnews.ca\/tag\/ford-government\">Ford government<\/a><\/span>\u00a0to court over a provincial law designed to free-up hospital beds, the effectiveness\u00a0 of that law remains unclear.<\/p>\n<p>The legislation \u2014 titled Bill 7: More Beds Better Care Act\u00a0<em>\u2014<\/em>\u00a0gave alternative level of care (ALC) patients in Ontario hospitals a choice: move to a long-term care home picked by the province \u2014 or face a daily fine of $400.<\/p>\n<p>The bill received royal assent and became law at the end of August, and hospitals were allowed to begin charging fines as of Nov. 20.<\/p>\n<p>The Ontario Health Coalition and the Advocacy Centre for the Elderly are\u00a0preparing a charter challenge against the legislation.<\/p>\n<p id=\"recirc_test_read_more\" class=\"c-readmore\"><span class=\"c-readmore__label\"><strong>Read more:<\/strong><\/span><br \/>\n<a class=\"c-readmore__link\" title=\"Advocates for elderly patients vow Charter challenge to Ontario LTC law\" href=\"https:\/\/country104.com\/news\/9293360\/advocates-for-elderly-patients-vow-charter-challenge-to-ontario-ltc-law\/\" data-track-region=\"content-read-more\"><br \/>\n<span style=\"color: #3366ff;\">Advocates for elderly patients vow Charter challenge to Ontario LTC law<\/span><\/a><\/p>\n<p>How effective the bill is \u2014 and how much it will be used \u2014 remains unknow.<\/p>\n<p>Ontario\u2019s minister of long-term care claimed up to 1,500 beds had become available in response to a question on Monday about how many people had been moved as a result of the new law.<\/p>\n<p>Speaking in the legislature earlier the same day, Paul Calandra also said that \u201cover 330 ALC patients have chosen to go to long-term care beds in the province of Ontario\u201d last week.<\/p>\n<p>Health minister Sylvia Jones said she had been told, anecdotally, that beds were becoming available.<\/p>\n<p>\u201cI am hearing from hospital CEOs who are saying on the ground in the hospital they have seen alternative level of care beds open up,\u201d Jones said.<\/p>\n<p class=\"c-readmore\"><span class=\"c-readmore__label\"><strong>Read more:<\/strong><\/span><br \/>\n<a class=\"c-readmore__link\" title=\"Independent conservative MPP slams Ontario government\u2019s health-care law as \u2018coercion\u2019\" href=\"https:\/\/country104.com\/news\/9134349\/bobbi-ann-brady-slams-ontario-health-care-law\/\" data-track-region=\"content-read-more\"><br \/>\n<span style=\"color: #3366ff;\">Independent conservative MPP slams Ontario government\u2019s health-care law as \u2018coercion\u2019<\/span><\/a><\/p>\n<p>However, several GTA hospitals approached by Global News said they were unlikely to use the powers to fine or move patients created by Bill 7, though many did express general support for the legislation.<\/p>\n<p style=\"padding-right: 150px;\"><iframe style=\"display: block; width: 0px; overflow: hidden; line-height: 0;\" class=\"mce_SELRES_start\">\ufeff<\/span>Analysis<\/strong><\/iframe><\/p>\n<p>Trillium Health Partners, which runs health care in Mississauga and Etobicoke, said no patients were transferred \u201cas a direct result\u201d of the legislation.<\/p>\n<p>\u201cWe fully support Bill 7 as an important tool to ensure patients are receiving the right care, in the right place,\u201d a spokesperson said.<\/p>\n<p>A spokesperson for Toronto\u2019s Sinai Health System said the hospital network had \u201cnot transitioned any patients to long-term care under the Act.\u201d<\/p>\n<p>The spokesperson said no one would currently qualify to be fined $400, adding \u201call patients who have moved to long-term care have done so through the long-term care placement process with consent.\u201d<\/p>\n<p>Toronto\u2019s Sunnybrook Health Sciences Centre said its \u201cmain issue with ALC patients isn\u2019t necessarily long-term care but rather other destinations such as rehab.\u201d<\/p>\n<p class=\"c-readmore\"><span class=\"c-readmore__label\"><strong>Read more:<\/strong><\/span><br \/>\n<a class=\"c-readmore__link\" title=\"London, Ont. widow speaks out against Bill 7 following husband\u2019s death\" href=\"https:\/\/country104.com\/news\/9103122\/london-ont-widow-speaks-out-against-bill-7\/\" data-track-region=\"content-read-more\"><br \/>\n<span style=\"color: #3366ff;\">London, Ont. widow speaks out against Bill 7 following husband\u2019s death<\/span><\/a><\/p>\n<p>Bill 7 allows hospitals or discharge planners to override patient consent to secure a bed as far as 70 kilometres away in southern Ontario and 150 kilometres away in northern regions.<\/p>\n<p>The <a href=\"https:\/\/country104.com\/news\/9284809\/ontario-bill-7-ltc-move-fines-effectiveness\/\">Ontario Health Coalition<\/a> is preparing a charter challenge to the bill, which its executive director describes as \u201cfundamentally discriminatory\u201d against the frail and elderly.<\/p>\n<p>\u201cWe\u2019re talking about pushing people out of hospitals to die. I mean, let\u2019s get real,\u201d Natalie Mehra said.<\/p>\n<p>\u201cIt\u2019s targeting the frail elderly. We believe it\u2019s fundamentally discriminatory and ageist and there are other solutions.
