Durling, The Pointer<\/p>\n<p><a href=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone  wp-image-21159\" src=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1.png\" alt=\"\" width=\"408\" height=\"354\" srcset=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1.png 3607w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1-300x261.png 300w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1-1024x890.png 1024w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1-768x668.png 768w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1-1536x1335.png 1536w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-1-1-2048x1780.png 2048w\" sizes=\"auto, (max-width: 408px) 100vw, 408px\" \/><\/a><\/p>\n<p><em>Natanael Melchor\/Unsplash<\/em><\/p>\n<p>When Ontarians first heard the Doug Ford government\u2019s plan to charge hospital patients, mostly seniors, $400 a day if they refused to be involuntarily uprooted from their hospital bed, residents flooded social media with their angry responses.<\/p>\n<p>Now, Bill 7, The More Beds, Better Care Act, is heading to court, after the Ontario<\/p>\n<p>Health Coalition (OHC) and the Advocacy Centre for the Elderly (ACE) launched a Constitutional Challenge to the PCs\u2019 controversial Bill, calling it an \u201cegregious violation\u201d of the Charter rights of elderly residents.<\/p>\n<p><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/thepointer.com\/article\/2022-09-19\/it-s-immoral-on-every-level-health-advocates-mpps-decry-pc-plan-to-charge-patients-400-a-day-for-refusing-hospital-transfers\">The Act received Royal Assent on August 31, <\/a><a style=\"color: #3366ff;\" href=\"https:\/\/thepointer.com\/article\/2022-09-19\/it-s-immoral-on-every-level-health-advocates-mpps-decry-pc-plan-to-charge-patients-400-a-day-for-refusing-hospital-transfers\">drawin<\/a><a style=\"color: #3366ff;\" href=\"https:\/\/thepointer.com\/article\/2022-09-19\/it-s-immoral-on-every-level-health-advocates-mpps-decry-pc-plan-to-charge-patients-400-a-day-for-refusing-hospital-transfers\">g<\/a><a style=\"color: #3366ff;\" href=\"https:\/\/thepointer.com\/article\/2022-09-19\/it-s-immoral-on-every-level-health-advocates-mpps-decry-pc-plan-to-charge-patients-400-a-day-for-refusing-hospital-transfers\"> the ire of opposition MPPs and health advocates<\/a><a style=\"color: #3366ff;\" href=\"https:\/\/thepointer.com\/article\/2022-09-19\/it-s-immoral-on-every-level-health-advocates-mpps-decry-pc-plan-to-charge-patients-400-a-day-for-refusing-hospital-transfers\">. It took effect November 20, and allows hospital patients to be<\/a><\/span> charged $400 a day if they refuse to be transferred to an alternative setting like a longterm care home or assisted living facility.<\/p>\n<p>Its critics have labelled the legislation as ageist and discriminatory toward the elderly population who will be disproportionately affected, and unprecedented in that it allows personal healthcare information to be shared without consent.<\/p>\n<p>The OHC points out that in Southern Ontario, patients will be transferred up to 70 kilometres away. In Northern Ontario, patients can be transferred up to 150 kilometres away, or if there are no beds available, any distance necessary to find appropriate care.<\/p>\n<p>If a patient refuses to go, the hospital is required to charge them $400 per day.<\/p>\n<p>Natalie Mehra, executive director of the OHC, said the group is currently filling out affidavits, <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/index.php\/donate-now\/\">acceptin<\/a><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/index.php\/donate-now\/\">g<\/a><\/span><a href=\"https:\/\/www.ontariohealthcoalition.ca\/index.php\/donate-now\/\"><span style=\"color: #3366ff;\"> donations<\/span><\/a> and seeking patients who are being pushed out into long-term care homes under threat of being charged $400 daily.<\/p>\n<p>\u201cWe\u2019ve been receiving correspondence from people all over Ontario who are really appalled at this legislation\u2013 people who are facing these circumstances in hospitals, people who have been wanting to support and donate. I\u2019ve done this for 27 years, and it happens, but it doesn\u2019t happen very often that you get such a mass of people who understand what the legislation is about and are just horrified that our province is doing this to the elderly.\u201d<\/p>\n<p>In one case, Mehra said a family is spending $4,000 a month for a retirement home to avoid being put in a long-term care facility against their choosing.<\/p>\n<p>\u201cI\u2019ve heard from another person that in order to prevent them from moving to a longterm care home that is awful, they moved her to one that is more than 100 kilometres away but it is decent.\u201d<\/p>\n<p><a href=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone  wp-image-21160\" src=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2.png\" alt=\"\" width=\"515\" height=\"604\" srcset=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2.png 2208w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2-256x300.png 256w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2-873x1024.png 873w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2-768x901.png 768w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2-1309x1536.png 1309w, https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/Picture-2-2-1745x2048.png 1745w\" sizes=\"auto, (max-width: 515px) 100vw, 515px\" \/><\/a><\/p>\n<p><em>(<a href=\"https:\/\/thepointer.com\/article\/2022-12-04\/pcs-bill-7-constitutionally-challenged-for-charging-hospital-patients-400-daily-when-refusing-involuntary-transfers\">Ontario Health Coalition<\/a>\/Twitter)<\/em><\/p>\n<p><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/LTC-waitlist-data-final.pdf\">With the challenge, the Ontario Health Coalition has compiled and released<\/a> <a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/LTC-waitlist-data-final.pdf\">a list of lon<\/a><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/LTC-waitlist-data-final.pdf\">g<\/a><a style=\"color: #3366ff;\" href=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/LTC-waitlist-data-final.pdf\">-term care homes<\/a><\/span><a href=\"https:\/\/www.ontariohealthcoalition.ca\/wp-content\/uploads\/LTC-waitlist-data-final.pdf\"><span style=\"color: #3366ff;\"> with the longest and the shortest wait times in each region<\/span><\/a> of the province to illustrate where patients would most likely be transferred to.<\/p>\n<p>\u201cThere\u2019s no appeal in the legislation or regulation and so this is our only way to challenge this. It <span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/www.justice.gc.ca\/eng\/csj-sjc\/rfc-dlc\/ccrf-ccdl\/check\/art15.html\">states<\/a><\/span> that \u201cevery individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.\u201d If the case is successful, the Superior Court can striked down Bill 7.<\/p>\n<p>\u201cThe purpose of the legislation and mandatory $400 fee is to intimidate and coerce older adults to leave hospital, to any destination, even those which are inappropriate,\u201d Jane Meadus, lawyer and institutional advocate at ACE, said. \u201cUnder this law, hospitalized senior&#8217;s personal health information can be sent to any long-term care home without their consent, breaching a fundamental right to privacy over health information that every other Ontario citizen enjoys.\u201d<\/p>\n<p>Steven Shrybman, lawyer at Goldblatt Partners LLP, said that because the intention, allegedly, is to coerce certain hospital patients who can no longer be cared for at home into being placed in a long-term care setting, it violates the fundamental right to require informed consent for medical treatment.<\/p>\n<p>\u201cBill 7 represents an unprecedented and egregious deprivation of the Charter rights of many elderly and vulnerable hospital patients in respect of both their right to life, liberty and security of the person and to equality,\u201d Shrybman said.<\/p>\n<p>Those who have been impacted by the legislation can email the OHC at: ohc@sympatico.ca.<\/p>\n<p><span style=\"color: #3366ff;\"><a style=\"color: #3366ff;\" href=\"https:\/\/thepointer.com\/article\/2022-12-04\/pcs-bill-7-constitutionally-challenged-for-charging-hospital-patients-400-daily-when-refusing-involuntary-transfers\">Click here for original article<\/a><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(December 4, 2022) By: Jessica R.
