{"id":22405,"date":"2012-06-11T16:19:50","date_gmt":"2012-06-11T20:19:50","guid":{"rendered":"https:\/\/www.ontariohealthcoalition.ca\/?p=22405"},"modified":"2023-01-18T16:51:02","modified_gmt":"2023-01-18T21:51:02","slug":"backgrounder-on-schedule-28-of-the-budget-bill-bill-55","status":"publish","type":"post","link":"https:\/\/www.ontariohealthcoalition.ca\/index.php\/backgrounder-on-schedule-28-of-the-budget-bill-bill-55\/","title":{"rendered":"<FONT COLOR=\"#E00000\"><\/FONT> Backgrounder on Schedule 28 of the Budget Bill (Bill 55)"},"content":{"rendered":"<p>(June 11, 2012)<\/p>\n<p>The Budget Bill (Bill 55) contains a dangerous section that, if implemented, could facilitate the largest\u00a0privatization of public assets and services in Ontario\u2019s history.<\/p>\n<p>Schedule 28 of the Budget Bill creates an u\u0308ber \u201cMinister of Privatization\u201d. This Schedule sets up new powers\u00a0for cabinet and a new Minister to override existing legislation and regulations to order the privatization of\u00a0public services, including health care, water, school boards, education, social services, hydro, and more.<\/p>\n<h4>New Extraordinary Powers to Privatize any Ministry, Agency, Board &amp;\u00a0Commission<\/h4>\n<p><em>Section 2 of Schedule 28 says \u201cThe Lieutenant Governor in Council (cabinet) may, by order, authorize the\u00a0Minister to enter into one or more agreements with any person or entity for the provision of Ontario\u00a0government services under this Act\u2026\u201d<\/em><\/p>\n<p>Section 3 of Schedule 28 defines what services the new\u00a0Minister of Privatization and Cabinet can privatize to for\u2010profit\u00a0or non\u2010profit corporations. This section enables the Minister\u00a0and cabinet to supersede existing legislation and regulations\u00a0that restrict such privatizations. Included in the list of services\u00a0and entities that can be privatized is virtually every part of\u00a0government, including:<\/p>\n<ul>\n<li>The Crown<\/li>\n<li>The government<\/li>\n<li>A ministry<\/li>\n<li>A government official<\/li>\n<li>A crown agency<\/li>\n<li>Or any other board, commission, authority or\u00a0unincorporated body of the crown.<\/li>\n<\/ul>\n<p>(Section 3, subsections 1 &amp; 2.)<\/p>\n<p><strong>\u201cUnder [Schedule 28] virtually all\u00a0<\/strong><strong>public services provided by the<\/strong><\/p>\n<p><strong>provincial government, its agencies or\u00a0<\/strong><strong>tribunals may be contracted out or<\/strong><\/p>\n<p><strong>privatized\u2026.Thus, the public health\u00a0<\/strong><strong>care insurance plan of the province<\/strong><\/p>\n<p><strong>could be contracted to a US based\u00a0<\/strong><strong>HMO; the electricity system of the<\/strong><\/p>\n<p><strong>province placed under the\u00a0<\/strong><strong>management of EDF Energy (the U.K.<\/strong><\/p>\n<p><strong>equivalent of the now defunct Enron\u00a0<\/strong><strong>Corporation); or provincial highways,<\/strong><\/p>\n<p><strong>together with the right to collect tolls,\u00a0<\/strong><strong>could be assigned to the consortium<\/strong><\/p>\n<p><strong>that now controls Highway 407.\u201d<\/strong><\/p>\n<p>Legal Opinion on Schedule 28 from\u00a0law firm Sack, Goldblatt, Mitchell<\/p>\n<p>Thus Schedule 28 covers every part of the government and public service. It is hard to imagine what could not\u00a0be privatized under this section of the Budget Bill.<\/p>\n<h4>Far More than Service Ontario<\/h4>\n<p>Claims by the Finance Minister and some media\u00a0that Schedule 28 is limited to the privatization of\u00a0Service Ontario (and that is bad enough) are not\u00a0true. In fact, Section 10 of the legislation\u00a0specifically states that for\u2010 and non\u2010profit\u00a0companies could be contracted to privatize\u00a0services in:<\/p>\n<ul>\n<li>Municipalities &amp; local boards under the\u00a0Municipal Act<\/li>\n<li>Any other authority, board, commission,\u00a0corporation, office or organization under\u00a0the authority of a municipality<\/li>\n<li>Universities, colleges, or other postsecondary\u00a0institutions<\/li>\n<li>School boards<\/li>\n<li>Hospitals<\/li>\n<\/ul>\n<p>Thus, Schedule 28 clearly applies to hospitals,\u00a0school boards, municipalities, social services,\u00a0municipal water systems, and all government\u00a0services; and it overrides all government ministries\u00a0as well as existing legislation and regulations.<\/p>\n<h4>International Trade and\u00a0Investment Treaties Would Make\u00a0Privatization Irreparable<\/h4>\n<p>If Ontario government services were to be\u00a0privatized under this Schedule, any attempt to\u00a0restore these services to the public sector could be\u00a0subject to a trade challenge under the WTO GATS\u00a0and the proposed Canadian\u2010European trade\u00a0agreement, CETA. Schedule 28 has been written\u00a0without any recognition of this danger.<\/p>\n<h4>Other Issues<\/h4>\n<p>Schedule 28 also enables private companies taking\u00a0over public services to collect and disclose personal\u00a0information, raising concerns that U.S. companies\u00a0may be compelled to share Ontarians\u2019 personal\u00a0information with U.S. authorities under the U.S.\u00a0Patriot Act.<\/p>\n<p>The Ontario Ombudsman is warning that privatized\u00a0services are not subject to Ombudsman oversight.\u00a0Schedule 28 also enables private companies to\u00a0charge fees for public services (potentially\u00a0highways or health care) and retain these fees for\u00a0their own profit. It enables companies to change\u00a0the licensing period for provincial licenses (like\u00a0OHIP cards or drivers\u2019 licenses).<\/p>\n<p>The government has opted not to publicly explain\u00a0the introduction of such sweeping new powers to\u00a0privatize, and instead is burying it deep inside the\u00a0Budget Bill. In fact, McGuinty has run repeated\u00a0elections on an anti\u2010privatization platform. The\u00a0people of Ontario have never been given any\u00a0democratic input on this legislation with its farreaching\u00a0implications for the quality, democracy\u00a0and cost of privatized public services.<\/p>\n<h4>We Are Calling for Schedule 28 to be Withdrawn<\/h4>\n<p>The Budget Bill is an omnibus bill, 327 pages long, that amends and creates a vast body of legislation. This\u00a0practice of creating far\u2010reaching legislation hidden in omnibus budget bills is undemocratic and must stop. The\u00a0public and opposition parties do not have proper opportunity to scrutinize the vast range of measures\u00a0included in the Bill. Measures such as Schedule 28 \u2013 which gives new powers to facilitate the largest\u00a0privatization in Ontario\u2019s history \u2013 can easily be slipped into omnibus bills that are hundreds of pages of dense\u00a0legal text, thereby escaping proper scrutiny and democratic debate.<\/p>\n<p>Schedule 28 of the Budget Bill has nothing to do with the budget. It has no place in a budget bill. It has\u00a0dangerous implications for social policy and the public interest.
