An Ontario court has thrown out a Charter challenge of a\u00a0long-term care law that allows hospitals to move people into homes they didn’t choose,\u00a0or charge them $400 a day if they want to go elsewhere.<\/p>\n

The case\u00a0\u2014 brought forward\u00a0by the Advocacy Centre for the Elderly (ACE) and the Ontario Health Coalition\u00a0\u2014\u00a0was heard in the\u00a0Superior Court of Justice in September and the decision was released Monday<\/a>.<\/p>\n

The two parties argued Bill 7, the More Beds, Better Care Act, violates the Charter of Rights and Freedoms. According to the province, however, the law\u00a0is\u00a0necessary to free up much-needed hospital beds.<\/p>\n

In the published decision, Justice Robert Centa says\u00a0the law doesn’t contravene the Charter of Rights and Freedoms. The bill\u00a0“does not interfere with an ALC [alternate level of care] patient’s ‘right’ to choose where they live,” and\u00a0the $400 daily\u00a0charge for a continued hospital stay\u00a0is “not coercive,” Centa wrote.<\/p>\n

Instead,\u00a0Bill 7 has a “sufficiently important objective,” the justice added.<\/p>\n

“I found that the purpose of Bill 7 is to reduce the number of ALC patients in hospital who are eligible for admission to\u00a0a long-term care home in order to maximize hospital resources for patients who need hospital-level care.”<\/p>\n

Natalie Mehra, executive director of the Ontario Health Coalition, told CBC News on Friday that the outcome is “distressing.”<\/p>\n

“We’re deeply, deeply disappointed. The problem still remains and it’s a major problem,” she said.<\/p>\n

“The patients are being pushed out of hospital, and these are frail, elderly patients\u00a0in the last weeks and months of their lives.”<\/p>\n

In an email Friday evening, Ema Popovic, spokesperson for Ontario’s minister of health, said the law “ensures people across the province receive the care they need, in a setting that is right for them.”<\/p>\n

“It\u00a0frees up hospital beds so that people waiting for surgeries can get them sooner, it eases pressures on crowded emergency departments by admitting patients sooner and it connects more people to the care they need when they need it,” she said.<\/p>\n

Popovic added that other provinces have had similar policies in place for decades.<\/p>\n

The controversy behind the law<\/strong><\/p>\n

The bill was passed by Premier Doug Ford’s government in September 2022, and has sparked\u00a0outrage among advocates, seniors and their caretakers.<\/p>\n

Bill 7 allows hospital placement co-ordinators to choose a nursing home for a patient who has been deemed by a doctor as needing\u00a0an alternate level of care,\u00a0without consent.<\/p>\n

Patients are still allowed to choose long-term care homes they prefer. But\u00a0if the home they want\u00a0has\u00a0a waitlist and the patient decides to stay in hospital while they wait for the home to become available,\u00a0they could\u00a0be charged\u00a0$400 a day.<\/p>\n

Hospital placement co-ordinators can also share\u00a0patients’\u00a0health information to long-term care homes without consent. Patients can\u00a0be sent to nursing homes up to 70 kilometres from their preferred spot in southern Ontario and up to 150 kilometres away in northern Ontario.<\/p>\n

At the Charter challenge hearing, the province brought forward evidence from several witnesses, which included hospital executives, doctors\u00a0and a leader of Ontario Health at Home, formerly known as Home and Community Care Support Services (HCCSS).<\/p>\n

David Musyj, currently the supervisor of London Health Sciences Centre, spoke about how patients who need an alternate level of care are at risk when staying in the hospital. He noted\u00a0they could be exposed to infections, could become less mobile and won’t have “enriching activities.”<\/p>\n

He also emphasized that by staying in an acute-care bed, the hospital can’t “transfer patients out of the emergency room” and can therefore “not accept new patients from the waiting room or ambulances into the emergency room.”<\/p>\n

This means\u00a0paramedics can’t transfer patients out of their care, which could leave a community without any emergency services available to respond (triggering what is known as a Code Black).<\/p>\n

Musyj\u00a0is temporarily with London Health Sciences.\u00a0His usual\u00a0position is as president and CEO of Windsor Regional Hospital.<\/p>\n

Another expert witness at the Charter hearing, Dr.\u00a0Abhishek Narayan, is interim program chief\u00a0and medical director fo the Primary Care, Rehabilitation, Complex Continuing Care, Palliative Care and Seniors’ Services programs at Trillium Health Partners.<\/p>\n

Narayan said that when they don’t have space for patients, it means people get cared for in “non-traditional spaces, such as hallways and auditoriums.”<\/p>\n

He added the hospital also then isn’t able to offer surgical services, increasing the chances\u00a0elective and non-urgent procedures get\u00a0cancelled.<\/p>\n

Family of person charged $26K calls ruling ‘disgusting’<\/strong><\/p>\n

Tecumseh\u00a0resident Michele Campeau said\u00a0her mom was charged $26,000 under the legislation last year because Campeau refused to move her mom out of a Windsor hospital and into a long-term care home that they didn’t want.<\/p>\n

After hearing the Charter challenge had been tossed,\u00a0Campeau told CBC she was “not surprised,” but “it’s disgusting.”<\/p>\n

She said she doesn’t agree with the ruling and hopes there’s another way the law can get overturned.<\/p>\n

Bill 7 “does violate their choice. Basically they’re telling you, ‘You take what we give you …\u00a0or we’re going to charge you this extraordinary amount of money,'” said Campeau, whose mom has dementia.<\/p>\n

Campeau\u00a0received a final bill last spring and says she still doesn’t plan to pay it.<\/p>\n

According to Mehra, the Ontario Health Coalition’s lawyers are reviewing the decision to determine whether it can be appealed.<\/p>\n

Mehra said\u00a0they still believe the bill violates\u00a0Charter rights,\u00a0and it threatens and pushes people into making decisions they might not be ready for.<\/p>\n

“We have a lot of people who phone [us] and they’re in distress, and they’re in the hospital and they’re sending in five people, [like a]\u00a0patient flow manager and a social worker, administrator and this and that, to try and pressure the patient or their loved one to move them out \u2014 anywhere, just anywhere,” she said.<\/p>\n

“And it’s just awful.”<\/p>\n

Mehra added there are still a lack of available hospital and long-term care beds, and the government still needs to find ways to deal with this.<\/p>\n
